Under the recent changes to bankruptcy law, it is more difficult to discharge your debts under Chapter 7. You must now submit to a "means test," demonstrating to the bankruptcy court that you lack the ability to repay your creditors over a three to five year period.
We will walk you through the requirements of the means test, so you know whether you can file for protection under Chapter 7. If you qualify, you will be allowed to discharge certain debts in exchange for the sale of non-exempt assets. We will make sure you understand which debts cannot be discharged, such as student loan payments, child support arrearages or certain tax obligations. We will also verify that exempt assets, including your principal residence, vehicle and retirement funds, are excluded from sale.
If you fail to qualify for a Chapter 7 filing, we will handle all aspects of a Chapter 13 reorganization for you. We will act as your advocate with creditors and the bankruptcy court, reviewing any proposed repayment plans to make certain they are within your means.
